Branson Slip and Fall Injury Claims

 If you sustained a slip and fall or trip and fall injury at a Branson hotel, Branson theater, Branson theme park or Branson resort there are several things which can affect your Branson personal injury lawsuit.

First and the most obvious question, what caused you or your family member to slip and fall?

For example, if you slipped in a spill at Branson theater, what was the substance and was the substance on the floor long enough for the manager to be aware of the spill?

Another example, is a slip and fall injury at a Branson hotel or resort where the fall was the result of a poor or dim lighting?

Second, were you supposed to be where you fell?  What were you doing at the time of the fall?

Third, would a reasonable person have been able to avoid the fall?  Was the condition "open and obvious" to anyone paying attention?

 Fourth, failing to report the slip and fall to the manager or some other employee.  This is especially important if you left the premises on a private car instead of an ambulance.  

Stick to the facts and don't give a statement.  Just let the employee know you or a family member fell over the unsafe condition.  Tell the employee what the condition is and get that persons name and position.  Do not admit to being at fault or say anything like "I should have been more careful" or "maybe I wasn't watching were I was going.

 

 Fifth, not getting evidence.  You need photos and witnesses.  Get names, addresses and phone numbers of people that witnessed your fall or witnessed the unsafe condition. This is important in the vacation setting of Branson as many witnesses may be from out of state.

Take photos and lots of them.  Hopefully you or a family member has a camera handy.  If not, buy a disposable camera.  You can not take too many photos.  Photograph the unsafe condition, you injuries, and if empoyees are changing or cleaning the unsafe condition.  Brusing, swelling, cuts and abrasions will heal.  If you damaged personal property save the property as is, or if you must have it repaired, photgraph the property as well.
